Uganda’s Constitutional Court upheld the Anti-Homosexuality Act of 2023.
The legislation imposes penalties of up to life in prison for same-sex relations while aggravated homosexuality attracts the death penalty.
In Wednesday’s ruling, Uganda’s Deputy Chief Justice said that the court would not provide a permanent injunction against the law’s enforcement.
“The Anti-Homosexuality Act being, in general, a reflection of the socio-cultural realities of the Ugandan society, and was passed by an overwhelming majority of the democratically elected representatives of the Ugandan citizens,” the ruling read in part.
However, the court nullified three sections of the act, saying they contravened the constitution- the ruling indicated that the sections violated the rights of gay people to access health, privacy, and freedom of religion.
